  • cadastral registration.

How to make parking on the site

When building a house, the question also arises: where on the land plot to place a personal car? After all, you need to choose a parking location and format in such a way that it looks appropriate and does not take up much space.

It is best to place parking next to the front door of the house to make it convenient to unload the car. While choosing a parking location is not so difficult, the type of parking space will depend on many factors and may vary depending on the needs of the owners.

It is easier to organize an open parking space on the site . They are also different:

  • An open gravel parking lot is an affordable and easy parking option. Before starting work, you need to remove the fertile layer of soil and fill it with sand.
  • An open parking lot made of concrete - such a platform is durable, but it should only be built on soil that is not prone to heaving.
  • An open parking lot made of paving slabs - it is better to take tiles measuring 30*30 cm or 50*50 cm and lay them on a sand floor.
  • An open parking lot made of stone tiles - it is important to remember that such material will require high-quality drainage.

When using this option, it is important to remember that the open parking space must be located higher than the land plot. This rule will help to avoid sagging under the weight of the car, because this can damage the area.

The second most difficult option is to make a parking space with a canopy. The canopy can be made from materials such as:

  • Polycarbonate - this material does not allow ultraviolet rays to pass through, so the car will not overheat.
  • Wood - this structure is considered durable, capable of withstanding high snow pressure.

For a parking space with a canopy, you need to build a foundation and make a frame. The height of the canopy can be calculated using the formula: car height + height of possible cargo or trunk.

And the most difficult option, which requires investment of money and effort, is building a garage. When building it, you need to remember important details:

  • Conducting electricity.
  • Water supply.
  • Drainage system.

The legislative framework

Separate legal acts on parking and parking near apartment buildings have not been developed. All issues are considered to one degree or another by the Housing Code of the Russian Federation. According to Art. 16 of the Housing Code of the Russian Federation it follows that the site on which the house is built and the adjacent territory are the property of the residents, and issues of its use are decided collectively by the apartment owners. This point is regulated by Art. 44 LCD. Residential premises means:

  • the house itself or part of it, including a room or part of an apartment;
  • auxiliary parts of buildings that serve to meet domestic needs and residence.

Norms and rules for creating parking spaces near an apartment building

The placement of a parking lot in the local area must meet certain requirements:

  • comply with fire safety standards (presence of fences made of fire-resistant materials, emergency escape routes, etc.);
  • availability of road access to the road junction (only for parking lots with more than 100 spaces);
  • comply with sanitary standards (the distance from the parking lot to the residential building is at least 10 meters and 25 meters from socially significant objects).

Parking for more than 50 cars must be located at least 50 meters from residential buildings and social infrastructure. Moreover, according to sanitary requirements, such a parking lot must be closed. A parking lot that accommodates more than 500 vehicles is prohibited from being located in a residential area.

Procedure for obtaining permits

The organization of parking spaces must fully meet the requirements of the Regulations of the Sanitary and Epidemiological Service 2.2.1/2.1.1.1200-03, which sets out the rules for the location of car parking in relation to a residential building.

Attention! The number of parking spaces should not exceed 50, no matter how long the house is. The distance to the front part from the parking lot must be more than 10 m when parking for 10 cars, and more than 15 m for a larger number.


As a rule, residents do not arrange parking on their own, but invite representatives of special design institutes with whom an agreement is concluded to do this. The design of the parking area must reflect:

  • parking plan;
  • land improvement plan;
  • traffic diagram.

Important! Road markings and sign locations must comply with traffic regulations. If necessary, fencing structures, equipment of security premises and the creation of checkpoints can be included in the plan.

The project must be agreed upon:

  • in the traffic police;
  • in the district administration;
  • in the Urban Planning Committee.

The agreed project, along with the application, is submitted to the Land Management Department. In addition, it comes with:

  • title documents for the land plot;
  • minutes of the general meeting;
  • cadastral passport for the house and surrounding area.

After all organizational issues have been resolved and the project has been agreed upon, you need to select a contractor who has the appropriate SRO approval and conclude an agreement with him.

When organizing parking in the courtyard of an apartment building, it is necessary to take into account the main requirement of the traffic rules: a car is not allowed to park in the courtyard of a building with the engine running. The term “parking” is considered to be a stop for more than five minutes without taking into account the embarkation/disembarkation of passengers. For this violation a fine of 1,500 rubles is imposed.

How to organize parking in the courtyard of a residential building

It is not necessary to disturb the authorities with parking issues. Residents of apartment buildings can solve this problem on their own. There are several ways to organize parking and traffic in the yard.

In recent years, the construction of the parking lot has been planned to begin a little earlier than the construction of the apartment building itself. SanPiN regulate the distance at which parking can be located. Its value depends on the number of parking spaces:

  • Less than 11 cars – minimum 10 m;
  • From 11 to 50 cars – at least 15 m;
  • From 51 to 100 cars – minimum 25.

If rows of garages are being built, then this distance is allowed to be reduced by 25% (a minimum of 10 m is maintained) if the following conditions are met:

  • Garages have no windows;
  • The entrance is not directed towards the residential windows of the first floors.

But this is all decided at the stage of building a house. If a problem arises with parking in an already built and inhabited building, you should start with a meeting of apartment owners. There, residents will determine whether they need an HOA, join it, if it exists, and whether full parking is really necessary.

Since homeowners own not only the apartment, but also the surrounding area, it is not only motorists who need to negotiate. People who require parking spaces should coordinate all procedures and plans with residents without cars.

Procedure

  1. First of all, we register the property adjacent to the cadastral register. If the house was built a long time ago, there is an HOA, then this will not be a problem, just visit the appropriate establishment. If the HOA has just started its activities, or it still does not exist, then you will have to first determine the boundaries and management of the property, then contact the cadastral chamber.
  2. Next, a vote or survey of all tenant-owners is organized. It is important that all participants are aware of the parking plans and express their opinions. In the end, everyone must come to one positive decision, otherwise disagreeing or unwarned residents may sue. The obligatory outcome of the meeting is the completed minutes of the general meeting. Important! The quorum when making a decision must be greater than or equal to 66.6%.
  3. Then the rules of SanPiN come into force. We check the area around the house for compliance with these provisions. Please note that parking lots with a capacity of more than 100 vehicles must obtain permission from firefighters.
  4. We take the minutes of the meeting to the local land management authority. An application for the issuance of a land plot drawn up there will be considered within three days. In practice, this period may be extended due to errors in the protocol and other circumstances.
  5. The next step is a visit to the traffic police. It is not strictly required, but the presence of paper from the state. inspection helps in case of controversial situations.
  6. After registration and receipt of the last documents, funds are collected. Then we turn to the design company to draw up a layout of the future parking lot, and we go with it to the construction company.

When considering the two concepts of “parking” and “parking in the local area”, it is necessary to understand that they relate to different areas of legislation. The term “parking” refers to the Civil Code (safety of the car), while parking is the terminology of traffic rules, that is, temporary stopping of the car.
