By personal account

Each payer for housing and communal services has its own personal account. Using its number you can find out the amount of debt for payment of services. It can be done:

Method of collection

There are several ways to collect gas debt - peacefully and judicially. The first option involves sending a claim to the debtor, the second - a statement of claim to the court or an application for the issuance of a court order.

Pre-trial proceedings

In the case of a peaceful option, it is necessary to send a preliminary notification of the existence of arrears in payment for the service. In this case, the debtor must receive the notice 20 days before the date of restriction or suspension, clause 119 of the Russian Federation Regulations of May 6, 2011 No. 354). The notice is sent by registered mail or delivered to the debtor against signature.

When does restriction and shutdown occur?

Suspension of the service will be possible if the debt is not paid within the period specified in the notification. A prerequisite is the presence of incomplete payment.

Payment is considered incomplete if the amount of debt for the service exceeds two monthly payments (clause 118 of the RF PP No. 354).

For violation of the obligation to pay for the service, the user is charged a fine (clause 14, article 155 of the Housing Code of the Russian Federation). Its size is tied to the refinancing rate of the Central Bank of the Russian Federation:

  • from the 31st to the 90th day - 1/300 of the rate for each day of delay;
  • from 90th – 1/130.

Through the court

This option is applicable in cases where the debtor evades fulfilling his obligations, despite the claims being sent and the service being suspended. The simplest solution in this case would be to send an application for a court order. The procedure is regulated by the rules of Chapter 11 of the Code of Civil Procedure of the Russian Federation.

The demand can be sent to the court only if the amount of debt does not exceed 500 thousand rubles (clause 1, article 121 of the Code of Civil Procedure of the Russian Federation).

Attached to the application:

  • calculation of the amount of debt;
  • receipt of payment of state duty;
  • claims that were sent previously;
  • power of attorney of the legal representative, if he is participating in the procedure.

A court order is issued within 5 days from the moment the appeal is received, without calling the parties to the dispute or their legal representatives (Article 126 of the Code of Civil Procedure). A copy of the court order is sent to the debtor. The latter has the right to submit his objections within 10 days from the date of receipt.

By the address

If you don’t know or don’t have a personal account number, you can also find out your gas debt by looking at the residential address.

There are several options to solve the problem:

  • a visit to a management company servicing a boring address,
  • contact any bank branch,
  • visit to a single settlement center.

In any of these institutions, an inspection will be carried out at the address (for example, St. Petersburg, N-skaya St., building No., Apt. No.). Based on the results, you can immediately make a payment and receive a receipt.

Limitation periods: can debts be written off if the deadline has passed?

The general limitation period, according to Article 196 of the Civil Code of the Russian Federation, is three years . It is calculated from the moment when the person learned or could have learned about the violation of his rights. That is, in the event of arrears in gas payments, funds can be recovered within three years.

The law does not oblige the supplier to “write off” debts. Debt write-off can only be done by a court within the framework of a lawsuit. That is, the interested party will need to send an application requesting the application of the statute of limitations.

The expiration of the statute of limitations does not deprive the supplier of the right to suspend the provision of services until the debts are written off.

The resulting debt can lead to the following negative consequences for the homeowner:
