Hello. At work, I very often need to find the owners of any real estate. Now I will focus specifically on non-residential premises. I will help you find out the details of their owners, but only if you already know the cadastral number of the premises. This already makes the task much easier. You don’t need to go anywhere; you can find out official and reliable information online via your computer or smartphone.

Important: In Russia there is a Unified State Register of Real Estate (USRN). It is administered by the Federal Service for State Registration, Cadastre and Cartography, or Rosreestr for short. This register contains and updates all information about Russian real estate, including its owners.

We create databases

Databases of owners, tenants and tenants of residential and non-residential premises in MKD - those documents that are included in the technical documentation of the house . This means that it is necessary to store them, keep records, and in the event of a change of management, transfer them to another management, HOA, cooperative or owners (depending on the new form of management).

According to paragraphs. “a” clause 25 of the Order of the Ministry of Construction of the Russian Federation No. 411/pr, these lists are an integral appendix to the management agreement for apartment buildings.

In fact, the databases are three separate (!) registries:

  • owners of MKD premises;
  • tenants of apartment building premises (indicating the type of premises (residential or non-residential), area of ​​the premises, number of residents and number of rooms in residential premises).
  • tenants of common property (if any).

In addition, the following data must be recorded, stored and updated in the lists:

  • apartment number in the house;
  • passport details of the owners;
  • details of the document that confirms ownership of the premises;
  • ownership share;
  • signature and date.

These registers are updated as the composition of owners and tenants changes. Naturally, there is no need to update them every day. We recommend that you update the information in the databases once a quarter.

Find out the owner of non-residential premises

This is where the first difficulties arise. The difficulty lies in the fact that there may be no one in the premises itself, nor in the building, nor near it with whom one could agree on the nuances of renting the premises. Where to go and where to look for information about the landlord? There are several ways that can shed light on the mysterious landlord of the premises. The first of them is to walk around the building in which the room is located, look at the walls of the building. Perhaps there is a small poster or sign hanging somewhere containing information about the owner of the building or the telephone number of the administration. Usually the building has an information corner or a buyer's corner if it is a shopping center. If the search was unsuccessful, then you can move on to the second method, namely, see whether the building is connected to electricity or water supply.

The easiest way is, of course, to look for premises in a newspaper advertisement or on a website under the “Premises for rent” section. In this case, you will be able to contact directly the landlord of the premises you are interested in, because, as a rule, the advertisement contains all the information necessary for communication. It’s a completely different matter if you personally liked the premises in some area of ​​the city. After walking around the premises, examining it from the outside, and once again making sure that it is ideal for your business, and this is exactly what you have long dreamed of, you will be interested in information about the landlord of this premises.

Database update

The management not only collects, stores, but also updates information about the owners, tenants and tenants of premises in apartment buildings (clauses “a”, “b”, paragraph 4 of section II of the RF PP dated 05/15/2013 No. 416 “On the procedure for carrying out management activities apartment buildings"). Let us remind you that the decision to conclude lease agreements for the common property of apartment buildings is made at the OSS.

Where can I get information?

You can obtain information data, knowing only the location of the object, from various sources, each of which guarantees the provision of complete and reliable information. The choice of source is individual and depends on the personal priorities of the applicant.

Online register

Rosreestr has launched its own online service, with which you can obtain a certificate from the register, which includes detailed information about a residential or non-residential building, including information about who is its owner.

ATTENTION! Information will not be provided if the property was acquired later than 1998 and the owner has not changed since then, as well as if it belongs to municipal, administrative or state property.

The service provides information:

  1. by number assigned from the cadastre;
  2. the address of the property.

The cadastral number can be found in the corresponding passport for the premises and entered in the appropriate field. When entering the address, indicate:

  • city;
  • Street;
  • house and apartment number.

After entering, a window will appear to select the desired object. If several addresses appear, for example, one indicating the city of a region, region, and the second simply indicating the city, you can click on any one. By clicking the “select” button, an online statement will appear containing the following information:

  1. object type and its status;
  2. region, city, property address, including zip code;
  3. quadrature;
  4. acceptable use;
  5. start of registration and updated information;
  6. cadastral valuation.

There is no charge for receiving data. If you want to obtain additional information, for example, about the encumbrance of the object, the number of owners, you will need to pay a fee.

To clarify who owns the premises, the necessary version of the extract from the register is selected. By clicking the “Get” section, the site will redirect to the order form, where you can carefully read the proposed rates.

ATTENTION! The cost of a standard statement will be 350 rubles; if you need to know information only about the owner’s full name, then you will have to pay only 90 rubles.

Having chosen the appropriate option, you can proceed to placing your order. You can pay for it using a card, electronic wallet or through the Euroset and Svyaznoy salons.

BTI appeal

When contacting this institution, you need to take into account that only the legal owners can obtain an extract or if there is a judicial request. This option is suitable if there is shared ownership of the premises.
This institution has information about the objects for which ownership has been registered and issues the appropriate papers for them. If it is necessary to obtain information about the owner of the apartment by cadastral number, an extract can be used.
You can obtain it from the BTI during a personal visit, having previously paid a state fee of 200 rubles. The application must be completed on site. After 3-5 days, the extract will be ready, it will indicate the full name of the owner of the premises.

Housing office

Another option for obtaining data is to make a request to the Housing Office. Archival data on changes of owners and their personal data are stored here.

IMPORTANT! Housing office employees do not provide information to any applicants. They have the right to disclose information to the owner, persons registered in the housing or an authorized person acting on behalf of the owner.

If you need to obtain an official document with a seal, you can ask the owner to give consent to perform these actions. To do this, the owner issues a notarized power of attorney. Obtaining certificates from the Housing Office is a free service.

Personal visit to Rosreestr

This organization is engaged in issuing documents not only online, but also in person by individuals and legal entities. To receive information, you will need to provide:

  • passport;
  • sample application;
  • duty payment receipt.

Employees of Rosreestr and the MFC provide assistance to visitors in resolving emerging issues, filling out applications, and filling out applications . As a rule, the extract is prepared in 3-4 days, it all depends on the region where the institution is located.

Through the tax office

As a rule, applicants planning or at the stage of purchasing a home turn to the tax office for information.

ATTENTION! To obtain information, when visiting the tax office, you must have a passport with you. The specialist will not issue an official document, he will only provide the required information.

Receiving an EZhD

Another option for obtaining information is to issue a single housing document (UHD). It contains and contains information from 13 documents. You can get it through the MFC. The paper of the owner or persons registered in the housing is given.

To receive the document you must have with you:

  1. passport;
  2. address of the location of the object of interest;
  3. confirmation of the right to receive information (for example, an extract from the Unified State Register of Real Estate).

Registration of an EZhD is free and it is issued on the day of application.

Request from a judicial authority

When it is necessary to establish the identity of the owner of a home and apply enforcement measures against him, but it is not possible to do this on his own, interested parties can go to court by filing a statement of claim.

When preparing a document, you can indicate that in order to clarify the requirements, it is necessary to clarify information about the owners. The court will have to establish the identity of the owner of the premises.

This service provides reliable information about the owners and find out who owns the apartment. All submitted documents are certified by the electronic signature of the Rosreestr registrar.

Why databases are important for OSS

The management body must have accurate information about the owners of residential and non-residential premises before holding the OSS - primarily to notify all owners about the upcoming meeting (clause 4 of article 45 of the Housing Code of the Russian Federation). In addition, it is also important to have information about the share of ownership, since votes at the OSS are determined not based on the number of people voting, but on the basis of those square meters that they own, as enshrined in Part 3 of Art. 48 Housing Code of the Russian Federation. Accordingly, based on this information, the MA determines:

  • whether there is a quorum at the meeting;
  • whether the issues put to vote were adopted.
