One of the articles of the Russian Constitution specifies the freedom of movement of citizens across the territory of the state, but legislation to some extent limits this right. The Law of the Russian Federation “On Freedom of Movement” No. 5242-1 and Decrees of the Government of the Russian Federation No. 713 of July 17, 1995 and No. 288 of September 12, 2012 regulate the procedure for registering both Russian citizens and foreigners temporarily staying in the country. The fine for lack of registration is imposed in accordance with Article 19.15.1 of the Code of Administrative Offenses of the Russian Federation.

What is registration

Every citizen of the Russian Federation knows what permanent registration in an apartment is. In accordance with the law, this is registration at the person’s place of permanent residence. At the same time, a special stamp with the residence address is placed in the latter’s passport, which has no time limit. There is another type of recording the movement of Russian citizens - registration at the place of stay for a certain period. What is temporary registration? According to the law, a limited version of registration by region of residence is used in cases where a person is located far from his permanent place of residence. Who needs temporary registration? A citizen of the Russian Federation who stays on the territory of any region or settlement for more than 3 months is required to register with the local branch of the Main Directorate for Migration of the Ministry of Internal Affairs of the Russian Federation. Temporary registration is automatically canceled upon expiration.

What does temporary registration provide? It is characterized by the following features:

  • Confirmed by a certificate of the established form.
  • Issued for a specific period (5 years).
  • You don’t have to contact the migration services to get an extract; you can wait until the registration expires.
  • Does not give the right to participate in privatization.

Otherwise, there is no difference between registration and registration. As practice shows, it is very problematic to kick a person out of temporary housing that is formalized according to all the rules.

The law gives an unequivocal answer to this question: all people with citizenship of the Russian Federation are required to register at their permanent residence address. When is temporary registration required for citizens of the Russian Federation? Only when a person leaves his place of residence for another region for a period of more than 90 days, as well as in the absence of permanent registration. If a person has not registered with the passport office, he may be subject to a fine for an administrative offense of up to 5 thousand rubles. In addition, a person without registration will not be able to obtain a foreign passport, driver’s license, apply for a loan, work in government agencies, or use other equally important services.

Why do you need permanent registration?

Although most citizens very rarely encounter situations where registration plays a role, having regular registration allows them to exercise a wide range of powers. Thus, any administrative procedure that is carried out solely on the basis of a person’s territorial affiliation is impossible without regular registration. So, having a regular registration, citizens can carry out the following actions:

  • request various types of material support from the state;
  • take advantage of the state’s social services, for example, enrolling children in school;
  • draw up various types of certificates from government agencies, and so on.

So regular registration gives citizens not only the right to live in the appropriate residential premises, but also to exercise some powers not related to residence. But according to a temporary registration sheet, one can only live in the appropriate housing for the period specified therein; a person will not be able to exercise other powers in the given area.

Having regular registration, persons can receive correspondence at this address. It is worth noting that most institutions, for example, banks, accept only his permanent place of residence as the return address of an individual - the counterparty. So, if possible, individuals are advised to apply for regular registration. The presence of regular registration does not in any way affect the right of citizens to obtain temporary registration in the relevant institutions, provided that there is a reason for this. In this case, regular registration is not canceled, but retained.

Types of registration

There are two types – permanent registration and temporary registration. Each of them has its own characteristics and is used in the following cases.

  1. At the place of residence. In this case, the person registers permanently with the migration service. A special stamp with the residential address is placed in the citizen’s passport. Why permanent registration is needed will be discussed in the next chapter.
  2. At your place of residence. If a person stays anywhere in Russia for more than 3 months, he needs to register with the migration service. Why do you need temporary registration? To avoid conflicts with law enforcement officials.

Why do you need to apply for temporary registration? This is a requirement of current law. Is temporary registration at the place of stay required? Yes, it is necessary, but if you stay in a given place for more than 90 days.

The issue of registration at the place of stay should first of all be taken care of by people living for more than 90 days at an address that does not correspond to their current registration.

The same deadlines also apply to citizens who have been discharged from their previous place of residence, but have not yet registered at their new place of residence.

In our country, registration is carried out on the basis of the following basic legislative documents:

  • Federal Law “On the right of citizens of the Russian Federation to freedom of movement, choice of place of stay and residence within the Russian Federation”;
  • “Rules for registration and deregistration of citizens of the Russian Federation at the place of stay and place of residence within the Russian Federation.”

The concept of registration as such has long ceased to exist. Officially in Russia there are two types of registration - permanent and temporary, which can be used both together and separately.

Only the owner of the given living space, or citizens registered in the apartment with the written consent of its owner, have the right to permanent registration at the place of residence. Not all homeowners go through this procedure, since cancellation of such registration in some cases is possible only through the court.

If you buy your own apartment, the law obliges its owner to obtain permanent registration in it within 7 days.

Thus, in the absence of personal living space, a citizen can legally reside without permanent registration. However, there are some nuances here too. If there is no registration mark at all in the passport of a citizen of the Russian Federation or he stays at his place of stay for more than 90 days without registration, this is equivalent to an offense and is fraught with serious consequences.

Why is registration required?

Why do you need registration? Registration with passport offices is necessary to control population flows and respect human rights, which are defined by the legislation of the Russian Federation. Below are various options for registration and the answer to the question: “In what cases is temporary registration necessary?”

  • In passport. The stamp in the passport indicates the person’s permanent place of residence. It reflects the main stages of the life of a citizen of the Russian Federation. A passport without registration deprives people of many necessary services that government and commercial structures provide to the population.
  • In another city. When is registration required at a person’s place of temporary residence? The answer to this question can be found in the law on freedom of movement. Only after forty stays in a certain area for more than 3 months, a citizen of the Russian Federation is obliged to register temporarily with the passport office of the local department of the Main Directorate for Migration of the Ministry of Internal Affairs.
  • To a minor child. According to the law, it is not necessary to register a minor citizen at the place of residence, but it is better to go through such a procedure. Simply, without a stamp in the passport or a certificate, the child will not be able to fully use the services of government agencies.
  • Newborn. Registration of a newborn at the place of residence is necessary in any case, although the procedure is not mandatory. Without a certificate, it is almost impossible to enroll a child in a kindergarten or school, or to obtain a compulsory health insurance policy.

Is registration required to obtain Russian citizenship? Needed. In this case, the person is registered temporarily with a permanent extension of the deadline.

What does registration give?

How is registration different from registration? Let's start with the first term. Having a permanent place of residence gives citizens more options regarding actions in the apartment/house.

For permanent registration:

  • A person can live on the territory indefinitely.
  • A citizen is given the right to participate in the privatization of municipal housing.
  • A person can dispose of his housing at his own discretion - sell, exchange, rent out, donate (if he is not just registered, but is the owner of the living space).
  • Permanent registration is expressed with a stamp in the passport, and children are given a certificate in the prescribed form.

I guess that's all. The decision to deregister from a permanent place of residence is made by the tenant or owner of the apartment. The country's migration services will have to be notified about this.

Is permanent registration necessary if there is temporary registration?

The legislation of the Russian Federation clearly distinguishes between the concepts of “place of residence” and “short-term stay”. In each of these cases, permanent or temporary registration must be issued. But there are some circumstances in which a citizen currently cannot register on a permanent basis and registers temporarily in someone else’s living space. Do you need permanent registration if you have a temporary one? It is not necessary, but for a certain limited period.

How long can you live without permanent registration in your passport using temporary registration?

If you can live as long as you like without permanent registration and have a temporary one, it is generally problematic to be in our country without registration in your passport. And living without registration in our country is considered a violation of the law , and for this you will have to bear responsibility to the fullest extent.

  1. An application in which the owner of the property makes an entry with a request to temporarily register the applicant in his living space. Or a separate application from the owner requesting temporary registration may be used.
  2. A document certifying the owner's right to this property.
  3. The document with which the applicant can prove his identity, most often a civil passport.
  4. If a person arrived from another state, a migration card will also be required.

Registration procedure

The procedure for permanent or temporary registration in the passport departments of the Main Directorate for Migration Affairs of the Ministry of Internal Affairs is practically the same. For permanent registration, a special mark is placed in the citizen’s passport on page No. 5, and for temporary registration, a certificate is issued on a standard form. For any type of housing registration, you must collect a package of papers that includes the following documents:

  • passport of a Russian citizen with all necessary records and stamps;
  • a completed application on government-issued form;
  • documents confirming ownership of housing (for owners);
  • permission from the owner of the property for temporary or permanent registration;
  • various certificates from the BTI and housing and communal services.

Many documents on the list require notarization. You can register at the passport offices of the GUVM during a personal visit, through an official representative of the housing and communal services, or using the services of multifunctional centers. Registration in Moscow for citizens of the Russian Federation does not differ from the generally accepted procedure throughout the Russian Federation. The law is the same for any municipality.

How to obtain temporary registration at the place of residence for a citizen without permanent registration

  • if the area of ​​the housing does not allow one more tenant to be registered in it;
  • when a citizen is deported during his previous visit to the country;
  • incomplete package of documents provided to the Federal Migration Service for temporary registration;
  • refusal is provided in writing. You can appeal the refusal to the FMS or through the court.
  1. When hiring, any employer will give preference to a citizen with permanent registration. The more reputable the company, the higher the position, the higher the financial responsibility, the less likely it is to get a job with temporary registration.
  2. Everyone wants to entrust a responsible post or material assets to a reliable person who can be found at a specific address at any time.
  3. To receive full medical care, you must purchase a medical insurance policy, and this requires permanent registration. A medical insurance will also be needed when enrolling children in kindergarten or school. In addition, none of us are immune from accidents.
  4. It is almost impossible to get a loan with this type of registration, and if any microcredit organization does this, the interest rates will be extortionate. This means that not only will it be impossible to use consumer lending, but microloans will also be unavailable.
  5. If you want to purchase an apartment with a mortgage, then if you have permanent registration, you can count on lower interest rates.
  6. It is impossible to purchase and register a car without permanent registration.
  7. It will be impossible to obtain a passport and a number of certificates.
