On April 24, 2021, the President of Russia signed a decree according to which residents of the DPR and LPR are allowed to obtain citizenship according to a simplified scheme: https://kremlin.ru/acts/news/60358. You can view its edition on our website.

On April 17, 2021, Federal Law No. 134 was adopted by the State Duma and approved by the Council of Federation on amendments to Federal Law No. 62, which significantly simplifies the procedure for obtaining citizenship: https://publication.pravo.gov.ru/Document/View/0001202004240038?index=0&rangeSize= 1.

Here are some new provisions that have long been awaited and discussed in society:

  • The requirement for foreign citizens to renounce their existing citizenship is excluded, regardless of the grounds for acquiring Russian citizenship;
  • The mandatory 5-year period of residence in the Russian Federation for foreign citizens is excluded, as well as confirmation of a legal source of funds for living in the Russian Federation for those who acquire Russian citizenship in a simplified manner;
  • When applying for admission to Russian citizenship in a simplified manner on the basis of marriage with a citizen of the Russian Federation, it is specified that the spouse who is a citizen of the Russian Federation must reside on the territory of the Russian Federation;
  • Foreign citizens and stateless persons who have a temporary residence permit or residence permit in the Russian Federation, who are married to citizens of the Russian Federation, will now have the right to obtain Russian citizenship in a simplified manner, provided that the spouse resides in the territory of the Russian Federation and the marriage has common children;
  • The rule on granting Russian citizenship outside Russia has been eliminated.
  • The basis for admission to Russian citizenship is the presence of citizenship of the Republic of Belarus, the Republic of Kazakhstan, the Republic of Moldova or Ukraine.

The amendments have already entered into force on July 24, 2020.

Foreigners can obtain Russian citizenship if certain conditions are met. How long the entire procedure will take depends on whether the Ukrainian citizen has grounds for simplified acquisition of Russian citizenship.

The legislation of the Russian Federation, namely FZ-115 and FZ-62, regulates several stages of legalization:

  1. Registration of Ukrainians after crossing the Russian border within the period established by the legislation of the Russian Federation.
  2. Obtaining a temporary residence permit in the Russian Federation (TRP).
  3. Obtaining a residence permit in Russia (residence permit).
  4. Acquiring Russian citizenship.

Obtaining Russian citizenship based on a Ukrainian passport looks like this:

  1. Obtaining a temporary residence permit (TRP). The first step on the path to a Russian passport will be the registration of a temporary residence permit. However, in some cases this status may not be made. For example, if you have a child or parent with Russian citizenship. In such situations, a Ukrainian has the right to immediately apply for a residence permit.   2. Registration of a residence permit (residence permit). This is the second stage and is required if you want to obtain Russian citizenship on the basis of a Ukrainian passport.
  3. Registration at place of residence. After receiving a residence permit, a Ukrainian needs to register in Russia. Using a residence permit, you can make migration registration or registration at your place of residence. But if you plan to apply for citizenship, then only the second option will do.
  4. Applying for citizenship. Having received a residence permit, a Ukrainian can collect documents and begin the procedure for obtaining the status of a citizen of the Russian Federation. You do not need to live under a residence permit for five years or any other period.

The document is issued at the border immediately after entering the country. If his family immigrates with a citizen of Ukraine, migration cards are filled out for each person, including minor children.

A migration card allows you to stay in Russia for 90 days in total for six months, after which an extension of your stay in the country is required.

Citizens of Ukraine have the right not to register in Russia at their place of residence for three months. However, an exception has been made for immigrants from the DPR and LPR - for them the period has been doubled (180 days) on the basis of Decree of the Government of the Russian Federation No. 1744. But registration will be needed to submit documents to the authorized territorial bodies of the Ministry of Internal Affairs of the Russian Federation when obtaining citizenship.

Obtaining a temporary residence permit

Citizens of Ukraine, after arriving in the country in 2021 and completing migration registration (registration at the place of temporary residence), can apply for a temporary residence permit in Russia.

Such a document gives the right to work and reside only in the region where the temporary residence permit is issued. At the same time, foreigners can count on all social benefits and medical care. The validity period of the temporary residence permit is three years, the document cannot be extended.

The legislation of the Russian Federation strictly controls the question of how many temporary residence permits can be issued to foreigners annually in each region through a quota system.

It is easier to issue this document outside the allocated quotas. The following categories of citizens of Ukraine can apply for them:

  • children whose parents (guardians) live under a temporary temporary residence permit in Russia;
  • children who receive temporary residence permits together with their parents;
  • a person who has a spouse - a citizen of the Russian Federation, subject to living with him in the same subject of the Russian Federation;
  • an incapacitated citizen together with guardians or parents;
  • investor in the Russian Federation;
  • a soldier while serving in the Russian forces;
  • a participant in the State Program for the Voluntary Resettlement of Compatriots and members of his family;
  • citizens of the former republics of the USSR who received education in Russia in state organizations of higher and secondary education under state-accredited programs;
  • citizens of Ukraine recognized as refugees or granted temporary asylum in Russia;
  • migrants in Russia on the basis of international treaties;

Other categories of applicants, citizens of Ukraine and stateless persons, also have the right to count on receiving a temporary residence permit outside the quota. For those citizens who do not have the listed grounds, they apply for quotas for obtaining temporary residence permits, which are not always enough.

To register a temporary residence permit, you must submit to the authorized territorial department of the Ministry of Internal Affairs of Russia at your place of residence:

  • application for issuing a temporary residence permit,
  • national passport,
  • medical certificate confirming the absence of dangerous diseases,
  • documents confirming the right to obtain a permit,
  • 4 color photos,
  • receipt of payment of state duty - 1600 rubles.

Obtaining Russian citizenship

The procedure for foreign citizens to obtain Russian citizenship is entirely regulated by Federal Law No. 62 “On Citizenship of the Russian Federation.” However, the procedure for simplified acquisition of citizenship has undergone changes, according to the new Federal Law-134, adopted in 2021.

General procedure

There is a general admission procedure for foreigners wishing to obtain Russian citizenship in 2021.

Article 13 of Federal Law 62 states that upon admission the applicant must meet the following criteria:

  • Have lived in the country continuously for at least 5 years.
  • Willingness to comply with the legislation of the Russian Federation and the Constitution.
  • Having a legal source of income.
  • Fluency in Russian and proof of your knowledge.

To obtain a Russian passport, you need to prepare a standard set of documents and submit it for consideration to the authorized territorial body of the Ministry of Internal Affairs of the Russian Federation. It includes:

  • Completed application.
  • Residence permit.
  • Passport or other identification document.
  • Birth certificate.
  • Certificates of marriage and birth of children, if available.
  • Extract from the house register.
  • Certificate of passing the Russian language exam.
  • Source of income.
  • Receipt for payment of state duty.
  • 4 photographs.

Simplified procedure for admission to Russian citizenship

In 2021, some visitors from Ukraine can count on a simplified procedure for obtaining Russian citizenship. This program is aimed at making the procedure faster and easier for those citizens who fall under its scope. The simplified scheme differs from the general one in several conditions:

  • The required standard period of permanent residence in the country is reduced or this condition becomes optional.
  • Russian language exams are cancelled.
  • You do not need to prove that you have income to support yourself and your family.
  • There is no need to renounce your existing citizenship.

There are a number of categories of applicants who can obtain a passport under a simplified scheme without renouncing their previous citizenship and observing a 5-year period of residence in the Russian Federation, the most common among them:

  • citizens of Ukraine, Kazakhstan, Belarus, Moldova;
  • persons whose parents have Russian citizenship and permanently reside here;
  • persons who previously had Soviet citizenship, but did not obtain citizenship of another country;
  • those born in the RSFSR and who previously had USSR citizenship;
  • those who have been married to Russians for at least 3 years; if there are children in the marriage, there is no time limit;
  • parents of incapacitated Russian children;
  • have received higher education in accredited universities of the Russian Federation and have been working in their specialty for at least 1 year;
  • native Russian speakers;
  • citizens of the Republic of Belarus, the Republic of Kazakhstan, the Republic of Moldova or Ukraine.
  • Resettlement Program participants;
  • entrepreneurs working in the Russian Federation for at least 3 years, whose payments and tax deductions total at least 1 million rubles per year;
  • investors;
  • in-demand specialists who have worked for at least 3 years in Russia;
  • WWII veterans;

The simplified procedure also applies to residents of the city of Sevastopol and the Republic of Crimea, which were part of Ukraine, but became part of the Russian Federation, as well as residents of the self-proclaimed republics of the LPR and DPR according to the Decree of the President of Russia of April 24, 2021.

From July 2021, citizens of the LPR and DPR only need to provide the authorized body of the Ministry of Internal Affairs of Russia with a document on permanent registration in one of the republics or an identity card containing this information. These papers will be the basis for admission to Russian citizenship.

The simplified legalization procedure differs in that a foreign citizen receives citizenship much faster. An application for a residence permit is immediately submitted. Documents are reviewed within three months. There is no need to obtain a temporary residence permit in Russia.

Simplified version for Ukrainians

Article 14 of the Law “On Citizenship of the Russian Federation” lists groups of people who have the right to preferential entry into Russian citizenship. Ukrainians who respond positively to at least one of the items on the list will be able to simplify the procedure for obtaining Russian citizenship.

  2. Ukrainians whose birth document lists the RSFSR as their country of birth;

  9. A Ukrainian who invests money in the Russian economy of at least 100,000,000 rubles;
  10. A Ukrainian who has been working in commercial and non-profit organizations in Russia for at least 3 years and has a high professional level in this specialty;
  11. WWII veterans;
  12. Ukrainians who served in the Russian army for more than 3 years;
  13. Ukrainians who are included in the program for the resettlement of compatriots living abroad;
  14. Ukrainians who speak Russian fluently.

Important! A simplified method of acquiring citizenship allows people to reduce the time they spend on the territory of the Russian Federation, which is necessary to obtain citizenship (up to 1 year). Also, the period for reviewing materials for obtaining Russian citizenship is reduced from those months to six months.

One of the priority reasons for foreign immigration to the country is the resettlement of compatriots who currently live in another state and want to return to Russia.

Since the government is interested in the influx of working-age population, it does its best to encourage foreigners to move to its territories, especially if they were previously residents of Russia or the USSR. Descendants of compatriots also have the right to resettlement.

The basis for relocation to the country is recognized as historical belonging to the local people, loss of citizenship after the collapse of the USSR, as well as voluntary renunciation of citizenship earlier.

As part of the “Compatriots” program, all necessary documents and photographs are submitted to the authorized territorial body of the Ministry of Internal Affairs of Russia. Decisions on applications from Ukrainians (or residents from other countries) are made within two months.

The resettlement program for compatriots has become unlimited since 2013. Its participants can be legally capable adults who, at the time of applying, have citizenship of the former USSR, acquired by them during the existence of this state.
